§1.
- These regulations for participation in educational classes for students held on the grounds of the Warsaw Archdiocese Cemetery at 14 Powązkowska Street in Warsaw (hereinafter referred to, respectively, as the "Classes", the "Regulations" and the "Cemetery") set out the rules and conditions and the mutual obligations of:
- the Organizer of the Classes – the Stare Powązki Foundation, with its registered office in Warsaw (01-797), at 14 Powązkowska Street, entered in the Register of Entrepreneurs and the Register of Associations, Other Social and Professional Organizations, Foundations and Independent Public Healthcare Institutions under KRS number 00008869; and
- the Person Registering for the Classes – a natural person registering their intention to participate in the Classes.
- The Classes take place on the grounds of the Cemetery, in particular in the following forms:
- outdoor classes (an educational walk) on the grounds of the Cemetery;
- meetings or discussions, competitions, or various forms of collaboration.
- The person responsible for organizing the Classes is an authorized representative of the Organizer of the Classes.
- The Classes take place with the knowledge and consent of the Board of Powązki Cemetery, with its registered office in Warsaw (01-797), at 14 Powązkowska Street, acting on behalf of the Warsaw Archdiocese, i.e. the administrator of the Cemetery.
- The instructors are appointed by the Organizer of the Classes.
§2.
- Parents or guardians are responsible for minors. Children must be accompanied by a guardian. The instructor representing the Organizer does not assume this role.
- Parents or guardians are responsible for minors participating in the Classes and must provide all necessary measures to ensure that minors participate safely and receive appropriate care.
- Participants in the Classes must behave in accordance with generally accepted standards of conduct in public places and refrain from any behavior that poses a threat to the safety of other people or to the Cemetery's property.
- The Organizer does not provide additional materials, such as guidebooks, etc.
- The Person Registering for the Classes must read and accept the Powązki Cemetery Regulations, available at: https://cmentarz.stare-powazki.pl/regulamin-cmentarza/. This applies in particular to the rules governing presence on the Cemetery grounds and prohibited conduct. Eating and drinking are strictly prohibited on the Cemetery grounds, and participants in the Classes must behave appropriately and respectfully.
- The Organizer does not insure participants in the Classes and accepts no liability in this regard. Participants themselves are responsible for their safety during the Classes held on the Cemetery grounds and during free time; in the case of minors, their guardians are responsible.
- The Persons Registering for the Classes are responsible for any damage caused by participants during the Classes. They are required to cover the costs themselves.
- The Organizer is not liable for accidents resulting from a breach of these Regulations.
- Participants in the Classes are responsible for securing their personal belongings. The Organizer is not liable for their loss or disappearance.
- The Organizer is not liable for any consequences of accidents causing personal injury or property damage that may affect participants in the Classes, or for damage resulting from unforeseen factors such as falling trees, sudden weather events, or the effects of flora and fauna.
- Persons on the Cemetery grounds in connection with the Classes agree to follow instructions given by the Organizer or its representative.
- The instructor has the right to cancel or stop the Classes in the event of adverse weather conditions or other circumstances that could endanger the safety and health of participants, including unacceptable group behavior or reasonable suspicion that one or more participants are under the influence of alcohol or other intoxicating substances, as well as in other cases where holding the Classes is significantly impeded. The Organizer or the instructor makes the decision in such cases. In such an event, the Organizer of the Classes is not liable for costs incurred by the Person Registering for the Classes.
- Being on the Cemetery grounds as part of the Classes involves the risk of hazards, including insect, tick or other animal bites, as well as hazards associated with moving around cemetery grounds (such as falling branches and the risk of tripping or slipping on uneven ground, etc.);
- Participants in the Classes must report any incidents that breach these Regulations to the instructor leading the educational Classes.
- The Person Registering for the Classes accepts responsibility for any consequences of hazards, breaches or failure to comply with the rules set out in these Regulations.
§3.
- To participate in the Classes, the Person Registering for the Classes must make an advance reservation using the form on the Foundation's website (https://fundacja.stare-powazki.pl/), and receive confirmation of the reservation date, meaning confirmation by the Foundation that the reservation has been accepted.
- Reservations for the Classes are subject to availability and are processed in the order in which applications are received.
- Reservations can be made no later than 2 days before the tour date.
- The maximum group size is 30 people. The Organizer may decide to cancel the Classes if the group is too small (in particular, if it would have fewer than 10 people).
- The Classes last 90 minutes.
- The duration of the Classes is fixed (the Classes are conducted according to a planned schedule). If delays to the planned schedule are caused by the Person Registering for the Classes, including when someone arrives late, the Classes will not be extended.
§4.
- Participation in the Classes constitutes consent to the collection and processing of personal data by the Organizer for the purposes of the Classes.
- Participation in the Classes constitutes the granting of the right to use the participant's image free of charge for publication on the Organizer's website and in other promotional or educational activities of the Foundation or the Cemetery.
- The Organizer shall make decisions on matters not covered by these Regulations.
